Welcome to YOUtopia Pools (“YOUtopia,” “we,” “us,” or “our”). These Terms & Conditions govern (A) your use of our website and (B) our design/build services. By using our site or hiring us, you agree to these Terms.

Website Terms of Use

1. Who may use the site

You must be at least 18 and legally able to enter contracts. Use the site only for lawful purposes.

2. Content & intellectual property

All text, images, graphics, logos, and designs on this site are owned by or licensed to YOUtopia and are protected by IP laws. You may not copy, reproduce, redistribute, or create derivative works without our written permission.

3. Prohibited uses

You agree not to:

• Interfere with site security or attempt to access non-public areas;
• Use bots/scrapers to harvest data;
• Post or transmit malware, spam, or unlawful, defamatory, or obscene material.

4. Third-party links

Our site may link to third-party websites. We are not responsible for their content or practices. Review their terms and privacy policies.

5. No warranties / limitation of liability (website)

The site is provided “as is.” We make no warranties of accuracy or availability and disclaim liability for any indirect or consequential damages arising from your use of the site.

Design & Construction Service Terms

These terms apply when you engage YOUtopia for design, construction, remodeling, or upgrades.

1. Estimates & scope

Proposals/quotes describe the scope of work, materials, allowances, schedule expectations, and price. Unless stated otherwise, estimates are valid for 30 days and may change due to market pricing or design revisions.

2. Changes & extras

Anything not listed in the signed scope is a Change Order and may affect price and schedule. Change Orders must be approved in writing (email is fine) before work proceeds.

3. Deposits & payment

• Typical milestones: Design retainer → Construction deposit → Progress payments → Substantial completion/final balance.
• Invoices are due upon receipt unless stated otherwise. Late balances may incur 1.5% per month (or the maximum allowed by law).
• We reserve lien rights under Florida law for unpaid balances.

4. Permits & approvals

We handle required permits and inspections unless the contract states otherwise. HOA/ARC approvals are the owner’s responsibility; we can assist with documentation.

5. Schedule & site conditions

We provide an estimated schedule and keep you informed. Delays caused by weather, supply constraints, inspections, change orders, strikes, acts of God, or conditions unknown at the time of estimate are not our liability but we’ll adjust the timeline reasonably.

6. Access, utilities & safety

Owner agrees to provide site access, usable electrical power and water, and to keep pets/children away from the work area. For safety, job sites are considered restricted areas during active work.

7. Materials & substitutions

We strive to supply the specified materials. If an item is unavailable, we may propose equivalent or better options for your approval.

8. Pool-specific notes

• Startup & water chemistry: We perform startup and provide owner instructions. Owner is responsible for ongoing water balance per manufacturer recommendations (unbalanced water can damage finishes/equipment and void warranties).
• Plaster/pebble curing: Variations in shade/texture are normal. Surface mottling, hydration streaks, or minor craze cracking may occur and are not defects.
• Hydrostatic pressure: Draining a pool without proper procedures can cause damage. Do not drain without our written guidance.
• Equipment location & noise: We’ll place equipment per plan; operational noise levels vary by brand/model and installation environment.

9. Warranties

• Workmanship: Limited workmanship warranty as stated in your agreement (typically 1 year unless stated otherwise).
• Manufacturer warranties: Equipment and certain materials carry manufacturer warranties administered by the manufacturer; registration may be required.
• Warranties do not cover misuse, neglect, unbalanced water, acts of God, or normal wear.

10. Clean-up & punch list

We keep a tidy jobsite and remove construction debris. At substantial completion, we’ll create a punch list with you and address items promptly.

11. Photography & portfolio

With your permission, we may photograph the project for our portfolio/marketing. We will not disclose your address or personal information.

12. Insurance

We maintain appropriate licensing and insurance for our operations. Certificates are available upon request.

13. Termination

Either party may terminate for material breach after written notice and reasonable opportunity to cure. You are responsible for payment for work performed and materials ordered to date.

14. Dispute resolution & governing law

These Terms and any services are governed by the laws of Florida. If a dispute arises, the parties will first attempt good-faith negotiation. If unresolved, disputes shall be brought in the state courts located in Pinellas County, Florida.

15. Limitation of liability (services)

To the fullest extent permitted by law, our total liability for claims arising from the project is limited to the amount you paid us for the specific portion of work giving rise to the claim. We are not liable for incidental or consequential damages.

Financing & Referrals

If you request financing information, we can introduce you to third-party lenders (e.g., Lyon Financial, HFS). We are not a lender and do not control their decisions, rates, or terms. Apply only if you agree to their policies.

Privacy

Your information is handled per our Privacy Policy. By contacting us or entering a contract, you consent to receiving service-related communications by email, text, or phone. You can opt out of marketing messages at any time.

Changes to these Terms

We may update these Terms periodically. The “Last updated” date shows when changes were made. Continued use of the site or services after changes means you accept the revised Terms.
